1. Agreement

These Terms of Service (“Terms”) govern your access to and use of Vismitha, including our website, checkout, and related features. By using the site, creating an account, or placing an order, you agree to these Terms and our Privacy policy. If you do not agree, do not use the services.

2. The marketplace

Vismitha is a multi-vendor marketplace. Independent sellers list products, set prices (subject to platform rules), and fulfill orders. We provide the platform, payment flows where applicable, and tools to connect buyers and sellers. A contract for the purchase of goods is between you and the relevant seller; we may assist with communication and dispute handling as described in our policies.

3. Accounts

You must provide accurate information and keep your login credentials confidential. You are responsible for activity under your account. We may suspend or close accounts that violate these Terms, pose a security risk, or misuse the platform.

4. Orders, pricing, and availability

• Product descriptions, images, and availability are provided by sellers. We do not guarantee that all information is error-free.
• Prices, fees, taxes, and shipping estimates are shown before you confirm checkout where the site supports it.
• We or a seller may cancel an order if an item is unavailable, there is a clear pricing error, or fraud is suspected. You will be notified and refunded where payment was taken.

5. Payment

Payments are processed through methods shown at checkout. You authorize us and our payment partners to charge your selected method for the total amount of your order, including applicable taxes and delivery fees. Refunds follow the seller’s and platform’s refund policy and applicable law.

6. Prohibited conduct

You agree not to:

• Attempt to gain unauthorized access to systems, other users’ data, or seller accounts.
• Circumvent fees, abuse promotions, or manipulate reviews or rankings.

Vismitha, its branding, and platform content we create are protected by intellectual property laws. Seller content remains the property of sellers or their licensors. You may not copy or reuse materials except as needed for personal use of the services or as we expressly allow.

8. Disclaimers

The services are provided “as is” and “as available” to the fullest extent permitted by law. We disclaim implied warranties where allowed. We do not guarantee uninterrupted or error-free operation. Sellers are responsible for their products; we are not the manufacturer unless stated for a specific item.

9. Limitation of liability

To the maximum extent permitted by applicable law, Vismitha and its operators will not be liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits or data, arising from your use of the site. Our total liability for claims relating to the services in a twelve-month period is limited to the greater of the fees you paid us for the platform in that period or a nominal amount where no fees applied, except where liability cannot be limited by law (such as gross negligence or willful misconduct).

10. Indemnity

You will defend and indemnify Vismitha and its team against claims arising from your breach of these Terms, your misuse of the site, or your violation of third-party rights, subject to applicable law.

11. Changes and termination

We may modify these Terms or discontinue features. We will post updated Terms on this page. Continued use after changes constitutes acceptance. We may suspend or terminate access for violations or operational reasons.

12. Governing law

These Terms are governed by the laws of the jurisdiction where Vismitha primarily operates, without regard to conflict-of-law rules. Courts in that jurisdiction have exclusive venue, except where consumer protection law requires otherwise.
